Family Pooling Terms & Conditions
***IMPORTANT: THE HEAD OF HOUSEHOLD (THE PERSON WHO STARTS THE FAMILY POOLING ACCOUNT) CONTROLS ALL TRUEBLUE POINTS IN THE FAMILY POOLING ACCOUNT. THE HEAD OF HOUSEHOLD CAN REDEEM TRUEBLUE POINTS FROM THE FAMILY POOLING ACCOUNT WITHOUT THE PERMISSION OF FAMILY MEMBERS.
THE HEAD OF HOUSEHOLD CAN REMOVE ANY PERSON FROM THE FAMILY POOLING ACCOUNT AT ANY TIME, AND ALL TRUEBLUE POINTS WILL REMAIN IN THE FAMILY POOLING ACCOUNT. IF YOU LEAVE A FAMILY POOLING ACCOUNT OR THE HEAD OF HOUSEHOLD REMOVES YOU FROM THE ACCOUNT, YOUR TRUEBLUE POINTS WILL REMAIN IN THE FAMILY POOLING ACCOUNT.***
Family Pooling is a general audience website and program open to TrueBlue members with their TrueBlue account in good standing (each, a "Participant" and collectively, "Participants"). A Family Pooling account can consist of up to two (2) adults aged twenty-one (21) or older and up to five (5) children under the age of twenty-one (21). For TrueBlue members under the age of thirteen (13), the parent or legal guardian of the child must enroll the child in Family Pooling and complete all Family Pooling activity. There must be at least two (2) individuals in a Family Pooling account. Void where prohibited by law. Participants may use Family Pooling for personal purposes only and not for any business, commercial or other use. Limit one (1) Family Pooling account per Participant. Any attempt by a Participant to register in more than one (1) Family Pooling account by using the same or multiple/different email addresses, identities, registrations, logins, and/or any other method(s), as determined in JetBlue's sole discretion, may void all TrueBlue Points that have been awarded or scheduled to be awarded to that Participant, and that Participant may be disqualified from participating in Family Pooling and/or TrueBlue at JetBlue's sole discretion.
How to create a Family Pooling account
In order to participate in Family Pooling, potential Participants must complete the electronic registration process and enter all required information. In order to start a Family Pooling account, you must be twenty-one (21) years of age or older. By starting a Family Pooling account, you are considered the "Head of Household." The Head of Household may invite other Participants into the Family Pooling account, subject to the Eligibility requirements described above; the Head of Household may invite one (1) other adult aged twenty-one (21) or older and up to five (5) children under the age of twenty-one (21). A TrueBlue member that is invited to join the Family Pooling account must accept the invitation by logging into his or her TrueBlue account and completing the electronic registration process and entering all required information. If the Head of Household invites a TrueBlue member who is under the age of thirteen (13) to join a Family Pooling account, that child's parent or guardian must access the child's TrueBlue account online to accept on his or her behalf.
As soon as one (1) TrueBlue member accepts the invitation from the Head of Household to join the Family Pooling account, the minimum number of Family Pooling account members has been satisfied, and the Family Pooling account is officially created. The date the Family Pooling account is officially created is called the "Family Creation Date."
Contributing points to a Family Pooling account
The Head of Household will manage the Family Pooling account as part of the Head of Household's own TrueBlue account. There will be a Family Pooling account tab on the Head of Household's TrueBlue account dashboard; when the Head of Household is logged into his or her TrueBlue account, the Head of Household will see (2) tabs, one (1) for the TrueBlue account and the other for the Family Pooling account. AS A RESULT, ALL OF THE HEAD OF HOUSEHOLD'S TRUEBLUE POINTS ARE AVAILABLE TO BE USED WITH THE FAMILY POOLING ACCOUNT.
If you accept an invitation from a Head of Household to join a Family Pooling account, you must agree to contribute at least ten percent (10%) of all of the TrueBlue Points that you earn after the Family Creation Date to the Family Pooling account. YOUR CONTRIBUTION PERCENTAGE SELECTION MAY NOT BE CHANGED FOR AT LEAST ONE (1) YEAR AFTER THE FAMILY CREATION DATE. YOU CAN ONLY CHANGE YOUR CONTRIBUTION PERCENTAGE ONE (1) TIME PER YEAR, BEGINNING ONE (1) YEAR AFTER YOUR FAMILY CREATION DATE.
You also have the option upon accepting an invitation to join a Family Pooling account to make a one-time, no-fee transfer of any amount of TrueBlue Points in your individual TrueBlue account to the Family Pooling account. ANY TRANSFER OF TRUEBLUE POINTS FROM YOUR INDIVIDUAL TRUEBLUE ACCOUNT TO A FAMILY POOLING ACCOUNT IS NON-REFUNDABLE. Any TrueBlue Point transfers you make after accepting the Family Pooling invitation will be subject to the applicable transfer fees and rules.
Your TrueBlue dashboard will give you access to a "My Family" tab, which will display each Family Pooling account member's contribution to the Family Pooling account.
Redemption of TrueBlue points from a Family Pooling account
The actual Family Pooling account will be under the Head of Household's individual TrueBlue account.
Participants can view and monitor the Family Pooling account activity under the "My Family" tab, located on their TrueBlue account homepage, but only the Head of Household can manage the Family Pooling account.
ONLY THE HEAD OF HOUSEHOLD CAN REDEEM TRUEBLUE POINTS FROM THE FAMILY POOLING ACCOUNT. THE HEAD OF HOUSEHOLD HAS SOLE AUTHORITY TO REDEEM TRUEBLUE POINTS FROM THE FAMILY POOLING ACCOUNT. THE HEAD OF HOUSEHOLD DOES NOT NEED PERMISSION FROM ANY OTHER PARTICIPANT IN THE FAMILY POOLING ACCOUNT IN ORDER TO USE THE POINTS IN THE FAMILY POOLING ACCOUNT.
The TrueBlue Terms and Conditions, available at https://trueblue.jetblue.com/web/trueblue/terms-and-conditions apply to all Points and TrueBlue award travel.
Changes to a Family Pooling account
You may remove yourself from a Family Pooling account at any time by going online to the My Family tab under the profile section in your TrueBlue account. IF YOU REMOVE YOURSELF FROM A FAMILY POOLING ACCOUNT, YOUR TRUEBLUE POINTS WILL STAY IN THE FAMILY POOLING ACCOUNT, AND YOU MAY NOT RE-JOIN THE ACCOUNT OR JOIN ANY OTHER FAMILY POOLING ACCOUNT FOR AT LEAST ONE (1) YEAR FROM THE DATE YOU WERE REMOVED.
The Head of Household may remove any Participant from the Family Pooling account at any time for any reason. IF THE HEAD OF HOUSEHOLD REMOVES A PARTICIPANT OR A PARTICIPANT REMOVES HIM/HERSELF FROM A FAMILY POOLING ACCOUNT, THE PARTICIPANT'S TRUEBLUE POINTS WILL STAY IN THE FAMILY POOLING ACCOUNT. THE HEAD OF HOUSEHOLD MAY NOT INVITE A NEW PARTICIPANT INTO THE FAMILY POOLING ACCOUNT FOR AT LEAST ONE (1) YEAR FROM THE DATE THE PARTICIPANT WAS REMOVED.
If a Participant in a Family Pooling account reaches the age of twenty-one (21) so that the Participant is considered an "adult" under the Program, the Head of Household may invite that Participant to be an "adult" in the Family Pooling account if there is an open space for an adult. (Family Pooling accounts have a maximum of two (2) adults). If there are already two (2) adults in the Family Pooling account, the Participant will automatically be removed from the Family Pooling account upon reaching the age of twenty-one (21). In this case, the Participant may immediately join or create a new Family Pooling account, and the Head of Household may immediately add another child under the age of twenty-one (21) to replace the Participant.
TrueBlue Mosaic and other TrueBlue Program bonus offers
Your eligibility for TrueBlue Mosaic and any other TrueBlue bonuses or offers is based solely on your individual travel and the number of TrueBlue Points you earn individually. Points in a Family Pooling account that are earned by other Participants will not count towards your eligibility for TrueBlue Mosaic or any other TrueBlue offers or bonuses.
Use of data/Privacy
BY PARTICIPATING IN THE PROGRAM, CERTAIN INFORMATION ABOUT YOU WILL APPEAR TO OTHER PROGRAM PARTICIPANTS, INCLUDING, BUT NOT LIMITED TO, YOUR TRUEBLUE PROFILE PHOTO, FIRST NAME, RELATIONSHIP IN FAMILY, AND THE NUMBER OF TRUEBLUE POINTS CONTRIBUTED TO THE FAMILY POOLING ACCOUNT.
You further grant JetBlue permission to contact you in any manner deemed necessary or appropriate regarding your participation in TrueBlue Badges. You understand that the Released Parties (as defined below) are not responsible for any unauthorized use of your information or content by any third party.
Modification or cancellation of Program or terms
JetBlue reserves the right to modify, suspend or cancel the Program and/or these Family Pooling Terms, in whole or in part, at any time. Any changes JetBlue makes will be effective immediately on the date of notice, which it may give either by posting the new terms on the TrueBlue site or by sending notice to Participants via e-mail. A Participant's participation in the Program after the date of such notice will be deemed acceptance of such changes. Participants should review these Family Pooling Terms periodically to ensure familiarity with the most current version. Participants will be able to tell when the version was last updated by checking the "Last Revised" date at the bottom of these Terms. All questions or disputes regarding the Program, including, without limitation, those involving eligibility, participation, fraud and abuse, will be resolved by JetBlue, in JetBlue's sole discretion.
Without in any way limiting the foregoing, JetBlue reserves the right, in its sole discretion, to cancel or suspend the Program (or any portion thereof) without notice should a virus, bugs, unauthorized human intervention, inclement weather or other causes corrupt administration, security, fairness, integrity or proper operation of the Program (or any portion thereof). CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, JETBLUE MAY DISQUALIFY ANY SUCH PARTICIPANT AND RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
General conditions, release, and limitation of liability
By participating in the Program, each Participant agrees to (i) be bound by these Family Pooling Terms; (ii) waive any and all claims against JetBlue, its subsidiaries, affiliates, and advertising and promotion agencies, and all of their respective officers, directors, shareholders employees, agents, representatives, and others working for them or on their behalf (collectively, the "Released Parties") for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, in connection with participation in the Program, including, without limitation, the acceptance, use or misuse of any TrueBlue Points or reward, the failure to obtain any TrueBlue Points or other reward, and/or any travel or activity related to the Program or TrueBlue Points or other reward; and (iii) indemnify and hold the Released Parties harmless from any and all losses, liabilities or expenses, including, without limitation, reasonable attorneys' fees, resulting from any claims, proceedings or investigations arising from or in connection with Participant's participation in the Program or compliance or non-compliance with these Family Pooling Terms.
Released Parties are not responsible for late, lost, incomplete, delayed, inaccurate, garbled, undelivered, misdirected Family Pooling invitations or notices or other communications, or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or problems of any kind relating to or in connection with the Program, whether printing, typographical, technical, computer, network, human, mechanical, electronic or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Program, the tabulating of TrueBlue Points, or in any Program-related materials. Persons found tampering with or abusing any aspect of this Program, who are acting in a disruptive or unsportsmanlike manner, who are engaging in fraudulent, unlawful or disruptive activity, or who are otherwise not in compliance with these Family Pooling Terms, as solely determined by JetBlue, may be disqualified from the Program and all badges and additional rewards that have been awarded or scheduled to be awarded to such Participant will be void and forfeited, all in JetBlue's sole discretion. Released Parties are not responsible for injury or damage to any Participant's or to any other person's computer related to or resulting from participating in this Program, including, without limitation, from downloading materials or use of the site.
Each Participant is solely responsible for any and all costs and expenses that may be associated with participation in the Program, including, without limitation, airfare, taxes and fees, air or ground transportation, tolls, gasoline, parking, or any other expenses associated with air travel.
Any attempt to participate in the Program via script, macro or other automated means will be void.
By registering and/or participating in the Program, you agree that: (i) you will resolve any and all disputes, claims and/or causes of action related to the Program (including, without limitation, any TrueBlue Points or related rewards) as an individual and not as a class or as a member of any class; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating the Program, and in no event will you be permitted to obtain attorneys' fees or other legal costs; and (iii) under no circumstances will you be permitted to obtain any award for, and you hereby waive all rights to claim, punitive, special, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. You also acknowledge and understand that, with respect to any dispute with us, our officers, directors, employees, agents or affiliates, arising out of or relating to your use of the Service or this Agreement: YOU ARE GIVING UP YOUR RIGHT TO HAVE A TRIAL BY JURY; and YOU ARE GIVING UP YOUR RIGHT TO SERVE AS A REPRESENTATIVE, AS A PRIVATE ATTORNEY GENERAL, OR IN ANY OTHER REPRESENTATIVE CAPACITY, OR TO PARTICIPATE AS A MEMBER OF A CLASS OF CLAIMANTS, IN ANY LAWSUIT INVOLVING ANY SUCH DISPUTE.
All disputes, issues and questions concerning the construction, validity, interpretation and enforceability of these Family Pooling Terms, or the rights and obligations of the Participants and JetBlue in connection with the Program (whether arising out of contract, tort or otherwise) shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of New York. Any legal proceedings arising out of this Program or relating to these Family Pooling Terms shall be instituted only in the federal or state courts located in the State of New York, County of New York, and you and JetBlue consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these Terms. The invalidity or unenforceability of any provision of these Terms shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. You understand that, in return for agreement to this provision and the dispute provision above, we are able to offer the Program at the terms designated, and that your assent is an indispensable consideration to this agreement.
